SMART Privacy Policy for Apps

The following explains the privacy policy of SMART Technologies (together with its subsidiaries, collectively "SMART") regarding the collection, retention, use and disclosure of Your (where "You" and "Your" includes the organization, institution or corporation this application is being used on behalf of) information collected via this SMART application ("App") that was designed for an Apple Inc. mobile device ("Device"). By using this App You consent to the privacy practices described in this policy ("Privacy Policy"). If You do not agree to these terms You must immediately stop using this App and remove it from Your Device.

In addition to this Privacy Policy You should make Yourself familiar with Apple’s privacy policy, published at: http://www.apple.com/privacy.

INFORMATION WE COLLECT

"Personal Information" is information that identifies You, which may be inputted and transmitted to SMART when You use this App. The Personal Information this App may collect, through Your direct entry of it, includes but is not limited to: Your name, address, phone number, email address, industry, serial numbers, operating system, pick-up address, ship-to address and optional photographs or videos.

"Technical Information" is information that does not identify You but includes, but is not limited to: technical information about Your Device and system.

As a result of using this App You may contact, or be contacted by, SMART via telephone, e-mail or postal mail. Any information You provide directly to SMART through any of these, or other, means is not covered by this Privacy Policy.

INFORMATION WE DO NOT COLLECT

This App does not request or collect the GPS co-ordinates or phone number of Your Device. However, if You submit or use photographs or videos taken with Your Device that information may be embedded in, or tagged to, these attachments. It is Your responsibility to remove this information from Your photos and videos if You do not wish SMART, or others, to have it. This App does not access or collect information from Your Device’s calendar, phone book or contact list.

With the exception of beta versions of this App, SMART does not collect or transmit Your Device’s Unique Device Identifier (UDID).

Do not send SMART or disclose any sensitive, proprietary, trade-secret, confidential information or inappropriate content (including photographs or videos) using this App.

RETENTION OF YOUR INFORMATION

We will retain Your information for the period necessary to fulfill the purpose of providing support for Your SMART products, unless a longer retention period is required or allowed by law.

If You would like Your Personal Information removed from any of SMART's databases or subscription lists please submit Your request by going to http://smarttech.com/contactcustomersupport.

USE OF YOUR INFORMATION

Personal Information is used to provide support for Your SMART products. This information may be used to create, cross-reference, supplement or replace information SMART has regarding You or Your products. Consequently, the information You provide may be used for marketing or other purposes if You had previously consented or opted-in to these activities. However, Your use of this App in itself does not operate as consent for direct marketing purposes. SMART may also use Personal Information to improve the functionality of this App and other SMART applications, SMART services, products and support.

Technical Information is used to facilitate the provision of App updates, App support, push notifications and other services to You (if any). It is also used to help SMART improve the features and functionality of its App and to better understand how this App is being used.

HOW AND WHY YOUR INFORMATION MAY BE DISCLOSED

SMART may disclose Your Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside Your country of residence; (b) to comply with a legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside Your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, You or others; (g) to allow us to pursue available remedies or limit the damages that we may sustain; and (h) if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires immediate disclosure of communications or Your Personal Information.

SMART may share Your Personal Information with third parties, such as channel partners, service providers or other organizations (i) where the third party or SMART has Your consent; (ii) where legally required or entitled to do so; (iii) where the third party is acting as our agent, contractor or service provider and has agreed to handle Your Personal Information in confidence and in accordance with applicable laws; and (iv) where business mergers, divestments or acquisitions are involved.

INTERNATIONAL USERS

Your Personal Information may be stored and processed in any country where SMART has facilities. These countries may be outside of Your country of residence and may provide for different and less stringent data protection rules than in Your country. If You object to Your Personal Information being transferred, processed, stored or used as described in this Privacy Policy, please do not use this App and immediately delete it from Your Device.

OUR POLICY REGARDING MINORS

This App is not intended for use by, or directed at, minors. If You become aware that a child under the age of 13 has provided us with Personal Information please contact us by going to http://smarttech.com/contactcustomersupport so that SMART may remove the information from its databases and subscription lists.

GENERAL

This Privacy Policy is governed by Alberta law and the applicable federal laws of Canada as this App, Your acceptance and the performance of, is performed entirely within Alberta, without regard to its choice of law or conflicts of law principles that would require the application of law of a different jurisdiction. You also agree the forum for any disputes are the provincial and federal courts of the Province of Alberta, City of Calgary, and such courts will have exclusive jurisdiction. This Privacy Policy does not limit any rights that SMART may have under trade secret, copyright, patent or other laws.
